Why should I make a Will?
Having a Will in place ensures your money and possessions pass on to your loved ones. Without a Will in place, you have no control over who inherits, and when they inherit. Some people assume that because they do not own a lot, they do not require a Will, however regardless of the size of your estate, it is important to have a Will making it clear where you would like everything to go. This makes it easier for your loved ones when you pass away.

Do married couples still need to make a Will?
Although it may be your wish that on first death everything passes to your husband/wife, it is important to look at who benefits on second death (when you have both passed away). Additionally, a number a married couples have different wishes including bequests and legacies. For these reasons, having an up to date Will in place is important.

Why should I make a Lasting Power of Attorney?
These documents allow a person/group of people the legal right to control your affairs should you be unable to. This can cover both Property & Financial affairs as well as Health & Welfare, and is a great way to ensure that your loved ones are able to act in your best interests regardless of what the future holds.

Who should I choose to be my Executors?
Most people choose their spouse/partner, children, or close relatives/friends. You can choose a legal representative or solicitor to act as a professional executor, but this is not mandatory. We recommend choosing at least two executors. This is in case one of your chosen executors passes away before you, there would still be an executor in place.

What would happen if I die without a Will?
Dying without a Will in place (dying intestate) means you may have no control over who inherits. As you would not have made your wishes clear, you would have no say over who benefits from your estate and this would complicate things for your surviving family and loved ones. Having an up to date Will in place eliminates any ambiguity. 

What if I no longer have full capacity?
You can only make a Lasting Power of Attorney if you have your full mental capacity, which is why it is important to make this as soon as possible. Without full capacity your loved ones will have to apply to the Court of Protection for a Deputyship order. This can be very costly and time consuming.
